Trucks cannot be parked on streets in residential areas

Chapter 10.08 on truck parking in the Holyoke Municipal Code states that vehicles at least 25 feet long or 12,000 pounds cannot be parked on residential streets or alleys. It is possible for a truck in violation to ultimately be sold at public auction.

 

Sec. 10.08.010.
Definitions.

The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Truck means a vehicle whose length is 25 feet or more or with a gross weight of 12,000 pounds or more.

Sec. 10.08.020.
Parking prohibited.

It will constitute a misdemeanor upon the part of the owner or operator, or both, of a truck to park such vehicle upon the public streets of the city or alleys of the city within that part of the city that is zoned residential RE, RI, R2, or where posted for a period longer than required for reasonable loading or unloading thereof.

Sec. 10.08.030.
Parking of detached trailers prohibited.

It shall be unlawful to park a detached trailer upon the public streets or alleys of the city.

Sec. 10.08.040.
Removal of vehicles.

The city shall remove and dispose of illegally parked commercial vehicles. In the event that prohibited vehicles under this chapter are not promptly moved within 24 hours after notification to operator or owner by complaint, warrant or sticker attached to the windshield of the offending vehicle, the city shall remove the vehicle to some available location and hold same until all fines, penalties and expenses incurred by the city in connection with removal to be included as costs to be paid by the owner or operator, are paid. If the fines, costs and charges are not paid or discharged within 30 days after notification to the owner of the vehicle, as shown by the motor vehicle records, such vehicle will be sold at public auction and the net amount received therefor, after payment of all of the above fines, costs and expenses, shall be paid to the owner of the vehicle. Insofar as may be practical, the sale of such vehicles shall be conducted as provided by law for mechanic and/or storage liens, and all costs of such sale will be added to above expenses.

Sec. 10.08.050.
Notification of violations.

Violations under this chapter may be communicated to the owner and/or the operator by summons, warrant or notice appended to the windshield, or other written communications.
