Curfew changed this year

Minors, along with their parents or guardians, should be aware of the curfew in Holyoke. Furthermore, the curfew was changed when the Holyoke Municipal Code was recodified this year, so it may be different than people remember it being.

A separate chapter in the code outlines the hours of use for public parks. Even before the curfew goes into effect, it is unlawful to be in the park, so be sure to take notice of both requirements.

 

Sec. 9.24.010.

Curfew for persons under 18 years of age.

It is unlawful for any person under the age of 18 years to remain or loiter upon any street, alley or other public place or way subsequent to the hour of 11:00 p.m. or prior to the hour of 5:00 a.m., except where there exists a reasonable necessity therefor or except where such person is accompanied by the parent, guardian or other person of at least the age of 21 years having permission of the parent or guardian who has the care and custody of such child.

Sec. 9.24.020.

Parent or guardian responsibility.

It is unlawful for any parent, guardian or other person having care or custody of any child under the age of 16 years to allow or permit any such child to remain or loiter on any public street, alley or other public way or place subsequent to the hour of 11:00 p.m. or prior to the hour of 5:00 a.m., except for lawful employment, or except where there exists a reasonable necessity therefor or except where such child is accompanied by his parent, guardian or other person of at least the age of 21 years having permission from the parent or guardian who has the care and custody of such child.

Sec. 8.36.010.

Prohibited in the city.

It shall be unlawful for any person to be in, upon or about the public parks of the city between the hours of 10:00 p.m. and 5:00 a.m., excluding the mini-park located at the intersection of Denver Street and Interocean Avenue and the Holyoke Ball Park located at 911 East Furry Street.

Sec. 8.36.020.

Permits.

Upon application to the chief of police, the chief of police or his designee may issue a permit for variance from the provisions of this chapter.

Sec. 8.36.030.

Penalties.

Any person or entity who violates this chapter shall be punished by a fine up to and including $300.00 for each violation.
